U.S. DISTRICT COURT JUDGE GREGORY FRIZZELL HAS DISMISSED A MOTION BY ARKANSAS POULTRY COMPANIES TO DISMISS OKLAHOMA'S LAWSUIT FOR POLLUTING THE ILLINOIS RIVER WATERSHED.
JUDGE FRIZZELL ORDERED A STATUS/SCHEDULING CONFERENCE FOR BOTH SIDES ON TUESDAY, JULY 23 AT 1:30 P.M.
AFTER 13-YEARS OF SILENCE, JUDGE FRIZZELL UPHELD OKLAHOMA'S ALLEGATIONS THAT THE POULTRY CORPORATIONS HAD POLLUTED THE ILLINOIS RIVER WATERSHED WTH THE NUTRIENT PHOSPHORUS.
TYSON FOODS, CAL-MAINE, CARGILL, GEORGES, PETERSON, AND SIMMONS POULTRY COMPANIES HAD MOVED THAT THE EVIDENCE IN THE LAWSUIT WAS NO LONGER VIABLE.
